Beware of KFBA.net!

KFBA jumped all over the Basketball Cafe last year and "bought" pretty much all the advertising we had to offer for the 2005/06 season. They paid a part upfront, but at the end of the season, they simply refused to foot the final bill (effectively taking money out of the Cafe's war chest from revenue that would have otherwise been guaranteed from other companies).

Now it's one thing to contest a bill after consumption (think of restaurant setting) and say you weren't aware you really had that much (even though the waiter was keeping tabs for you where you could see it). But it's totally something else to simply run away from any and all responsibility and not even try to find a decent solution when two (former) partners don't see eye to eye.

So here's a friendly heads up, be careful when dealing with KFBA - next time it might be your money (or the services you paid for) that are on the line. Feeling lucky?

Good questions actually. :-? The problem is that I'm not 100% sure if that would get me in legally hot water myself, as they paid the smaller side ads upfront, the issue was about the main banner. Can I confiscate one item for another? In real life, the cops can, but can I? 8-o

Menyak, how is your contract with KFBA structured? Did they agree to pay a lump sum X for both the banner ad and the side ads? Or X for the banner, and Y for the side? Is it one contract, or two separate contracts?

I'm not an attorney, but generally speaking, if they are in default on a contract, you are not obligated to hold up your end of the deal, either.

I'm assuming total costs of fighting them if they sue because the cafe removes their ads they actually did pay for would be near equal or greater to the value of the money they owe on the banner ads.

They have a crap set up and style of FBKB anyway.

I've removed their ads some time ago, so us advertising a service we cannot recommend isn't an issue anymore.

Funny that you'd ask, because yesterday was the 1-year anniversary since we last heard of them. Last October they told us we were evil by keeping this old story up for so long and threatened us with legal action (I kid you not), but it appears that cleaning up their act didn't come to their minds, so their mentality really hasn't changed that much over the years. :-[
